Terms of Service – Abby Wonderland

Participation Agreement

I, the Guardian with my name set forth in Registration Page hereby certify that I am the parent or guardian of the child/children whose name is set forth in Registration Page and I consent to his or her participant in the activities offered by Abby Wonderland Sdn Bhd (Business Registration Number 202301003611 (1497530-P)) with the business address at 4^th Floor, Mall 1, Boulevard Shopping Mall, Jalan Tawi Sli, 93250 Kuching, Sarawak. (“Abby Wonderland”).

In consideration of the child/children being permitted to enter Abby Wonderland indoor playground facility (“Playground), I the undersigned acknowledge and agree as follows:

I agree to, and shall ensure the child/children use the Playground only in accordance with Abby Wonderland playground rules and safety tips (“Rules”). I acknowledge that failure to abide by the Rules or to use the equipment in a safe and appropriate manner may, at the sole discretion of Abby Wonderland, result in me or the Child’s/Children’s removal from the Facility.

I understand and agree that I will be solely responsible for any and all costs to repair or replace any damage to the facility and/or the equipment therein incurred by the child/children and myself outside of normal wear and tear.

I represent and warrant that the child/children is/are in good physical condition and physically able to play in the Facility and that the Child/Children is/are old enough to participate.

I agree and acknowledge that my execution of this Waiver on the initial visit, will and does authorize Abby Wonderland to enter this Waiver into its database and use it as a continuous, multi-use waiver for my Child/Children ongoing entry to play in the Facility. I hereby expressly authorize Abby Wonderland to use this Waiver as a multi-use waiver.

I understand and agree that Abby Wonderland, its shareholders, officers, directors, employees, management, or other representatives (the “Representatives”) shall not be liable for any injury, damage or loss that I or the Child/Children may suffer as a result of using the Facility. I understand and agree that Abby Wonderland and its Representatives are not responsible for the supervision of the Child/Children.

I hereby release, waive and forever discharge Abby Wonderland and its Representatives from any and all liability, claims, demands, losses, or damages, however caused, whether related to property damage, theft, and/or personal injury (including death), and whether based on tort, intentional act, strict liability and/or negligence, that I or the Child/Children may suffer as a result of the Child/Children using the Facility.

I grant Abby Wonderland permission to use any photographs or video obtained of me or any child/children at playground for any legal use including but not limited to: publicity, advertisement and web content.

I agree that Abby Wonderland has the right to close the whole or any part of The Playground or suspend the operation of The Playground at any time for any technical or operational reasons (including staff illness), capacity, special events, or to ensure the safety and security of guests, or if Abby Wonderland believe there is a need to.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY AGREEMENT, FULLY UNDERSTAND ITS TERMS AS A LEGALLY BINDING CONTRACT AND UNDERSTAND THAT I HAVE GIVEN UP LEGAL RIGHTS FOR MYSELF AND THE CHILD/CHILDREN BY SIGNING IT, FREELY AND VOLUNTARILY WITHOUT INDUCEMENT. FURTHERMORE, I ACKNOWLEDGE & AGREE THAT I WILL SUPERVISE CHILD/CHILDREN UNDERSIGNED AT ALL TIMES AND CERTIFY THAT ALL OF THE BELOW PROVIDED INFORMATION IS TRUE AND CORRECT TO THE BEST OF MY KNOWLEDGE.

Playground Rules

This playground is suitable for children under 130cm in height.
All children must be accompanied by a parent/guardian of at least 18 years old and above.
1 child can only be accompanied by 1 parent/guardian.
Wristbands are to be worn at all times inside the playground and not transferable.
Sock must be worn at all times inside the playground. Shoe shall be placed in the shoe rack.
Baby strollers are required to be parked outside the playground area.
Children are advised to wear long trousers and long-sleeved shirts to minimized burns and scrapes
Jewellery is worn at your own risk and children wearing glasses should take particular care. All personal belonging brought into or stored within the premise shall remain under the care of the individual. Abby Wonderland shall not be responsible for any loss.
Food or drinks and sharp objects should not be brought into the playground
Parent/guardian are not allowed to enter the structure on the playground area
No blocking at entrance area or climbing on safety net.
It is forbidden to stay in the pipeline for a long time, so as not to affect the passage of other children;
No pushing, hitting or yelling. Abby Wonderland reserve the right to ask unruly or violent patrons to leave
Children who is sick is not encourage to enter the playground. Abby Wonderland may at our sole discretion, restrict entry of any children who in is deemed to be unfit for the playground.
In case of children vomiting or emergencies, please contact the staff in time for proper treatment.
A cleaning fee will be charged if a child spill bodily fluid (eg urine, stool, vomit etc) within the premises.
Additional charges will be imposed on children who has exceeded stipulated hours.
Children and parents/ guardians should understand that injury can be avoided if children and parent/ guardians follow this rule or take advise on safety tips seriously.

Pit Ball Pool Safety Tips

Younger children should wear diapers when entering this Pit Ball Pool
Do not hide inside the Pit Ball Pool or jumping into Pit Ball Pool from high area.

Trampoline Safety Tips

This trampoline is designated for children weight below 100kg.
Children below 5 years old are not allowed in the trampoline section (unless accompanied by parent or guardian)
Do not jump too high to prevent injury.
Strictly only one person per trampoline at any one time
Always jump & land in the centre of the trampolines

Do not wear jewellery, necklaces, earrings or having loose item in pocket when using the trampoline.
No pushing, hitting, pulling or chasing in this area.
Do not climb over the guardrail, and no objects should be thrown onto the trampoline
No hiding inside the Sponge Pool or jumping into Sponge Pool if there is another child in the Sponge Pool.

Slide Safety Tips

The slide is only for children over 5 years old and under 12 years old (40 kg) to play
Children should not be standing on slide, climbing the slide, pushing or pulling other children.
Children should always slide down feet first and sitting up, never head first or on their back or stomach
Children should take turns using the slide and wait for the child at the bottom to be off the slide and out of the way before sliding.

RETURN, REFUND AND SHIPPING POLICY

RETURN POLICY

The following are the policies to be eligible for exchange requests after shipment / receipt of goods:

Purchase that is delivered with wrong item or damage is not cause by buyer.
The purchase is made from Abby Wonderland.
Abby Wonderland is informed within 7 working days (email: [email protected]) from the date of goods received.
You have proof of purchase (order invoice number and receipt).
Item must be returned in the original box (or at least a suitable packaging) to protect the Product from damage during return delivery. We will not be liable to any refund if the return is made without our consent.

REFUND POLICY

Any purchases from our website (Products and Services) will not be refunded. Please ensure that your purchase and the details of your purchases are accurate.

SHIPPING POLICY

Abby Wonderland will only ship to addresses provided in the billing address or shipment address provided during your purchase.

Abby Wonderland will not be liable in the event of an incorrect shipping address is provided and goods are returned to us. You will be charged for additional shipping fees for a second delivery attempt.
